Article 1 - Definitions

For the purposes of these terms and conditions, the following definitions apply:

  • Cooling-off period: the time frame within which the consumer may exercise their right to cancel;

  • Consumer: an individual who is not acting for the purposes of their trade, business, or profession, and enters into a remote agreement with the trader;

  • Day: a calendar day;

  • Long-term transaction: a remote agreement concerning a series of products and/or services, the delivery and/or performance of which is spread over time;

  • Durable medium: any tool that enables the consumer or trader to store information addressed personally to them in a way accessible for future reference, allowing for unchanged reproduction.

  • Right of withdrawal: the consumer's ability to withdraw from the remote agreement within the cooling-off period;

  • Trader: a natural or legal person who offers products and/or services to consumers from a distance;

  • Distance contract: an agreement made within a trader's organised system for the distance sale of products and/or services, completed exclusively by means of one or more distance communication technologies;

  • Means of distance communication: a method that allows an agreement to be made without the consumer and trader being in the same physical location.

  • General Terms and Conditions: these General Terms and Conditions of the trader.

Article 3 - Applicability

These general terms and conditions apply to every offer from the trader and to every distance agreement and order made between the trader and the consumer.

Before concluding a distance agreement, the text of these terms and conditions shall be provided to the consumer. If this is not reasonably feasible, it will be indicated that the terms and conditions are available at the trader's premises, and they will be sent to the consumer upon request.

In cases where a distance agreement is concluded electronically, the text of these terms and conditions will be made available electronically in such a way that the consumer can easily store it on a durable medium.

In case of conflicting conditions, the consumer may rely on the most favourable applicable provision.

If any part of these terms is found to be void, the remaining terms and conditions will still apply. The void provision will be replaced with a provision that closely approximates its original intent.

Article 4 - The offer

  • Offers with a limited duration or special conditions will be clearly stated in the offer.
  • The trader reserves the right to amend the offer.
  • Descriptions and images of products and services are truthful and accurate, but minor variations are possible.

Article 5 - The agreement

An agreement is concluded when the consumer accepts the offer and meets the terms stated. If accepted electronically, the trader will confirm the acceptance immediately.

The trader may verify the consumer’s ability to meet payment obligations before concluding an agreement. If necessary, the trader can decline an order based on reasonable grounds.

Upon conclusion, the trader will send relevant information, including complaint procedures, withdrawal instructions, and total costs, in writing or electronically.

Article 6 - Right of withdrawal

Upon delivery of products:

  • Consumers have the right to terminate a product purchase agreement within 14 days without giving reasons. The cooling-off period starts the day after the consumer or a third party receives the product.
  • If the order includes multiple products or installments, the cooling-off period starts the day after the final item is received.
  • If legally required information regarding withdrawal is not provided, the cooling-off period may extend by up to 12 months.

During the cooling-off period, the consumer must handle the product carefully and may inspect it only as permitted in-store. If withdrawal is exercised, the consumer will notify the trader within the 14-day period and return the product in its original condition and packaging.

The consumer bears the cost of returning the product, unless the trader did not specify these costs or offers to cover them.

If a service starts during the withdrawal period upon consumer request, a proportional charge will apply for services provided until withdrawal.

Article 7 - Costs in case of withdrawal

If the consumer exercises the right of withdrawal, they will only bear the direct return shipping costs. If a payment has already been made, the trader will refund the amount as soon as possible, and no later than 14 days after receiving the return notice.

If a more expensive shipping option was chosen, the consumer may only be refunded for the standard delivery amount.
